These terms govern your use of Conek — the web application at conek.com and the Conek mobile apps for iOS and Android.
Conek is provided by A-SAFE (UK) Ltd, registered in England and Wales under company number 5407505, registered office Habergham Works, Ainleys Industrial Estate, Elland, West Yorkshire, England, HX5 9JP, VAT number GB 893 1518 05 (“A-SAFE”, “we”, “us”).
1. Who may use Conek
Conek is A-SAFE’s business platform. It is available to:
- A-SAFE employees;
- third parties working with A-SAFE, such as distributors, installation partners and contractors; and
- A-SAFE customers and the people they authorise.
Everyone uses Conek through an account A-SAFE issues, scoped to their organisation and role. There is no open public sign-up, and the apps do nothing without an account.
If you are an A-SAFE employee, your use of Conek is also governed by A-SAFE’s internal IT, acceptable-use and data-protection policies. Where those policies say something different from these terms, they apply to you in addition to these terms, not instead of them.
If you use Conek on behalf of a customer or partner organisation, any written agreement between that organisation and A-SAFE governs the relationship and prevails over these terms where the two differ.
2. Your account
Your account is personal to you. Do not share your credentials, and report a suspected compromise immediately to conek.dev@asafe.com.
A-SAFE administrators can create, suspend, change the permissions of, and delete accounts, and can access the data in the platform — including records you created. Conek is A-SAFE’s system of record, not personal storage.
3. Acceptable use
You agree not to:
- use Conek unlawfully, or to store or transmit unlawful, infringing or harmful content;
- access data you are not authorised to reach, or attempt to defeat the permission model;
- probe, scan, overload, disrupt or circumvent the security or rate limits of the service, except under written authorisation from A-SAFE;
- reverse engineer, decompile or copy the software, except to the extent that applicable law expressly permits it;
- export, copy or share A-SAFE’s commercial data outside the business, or take it with you when you leave;
- use automated means to extract data at a scale or in a manner that the documented APIs do not support;
- record a telephone call through Conek where doing so would be unlawful in your jurisdiction or the other party’s, or without the disclosures the law requires.
Access that threatens the security, integrity or availability of the service may be suspended without notice.
4. The data in Conek
All business data in Conek — customer records, quotes, orders, drawings, pricing, catalogue content — belongs to A-SAFE. You are given access to it to do your job, and for no other purpose. Your obligations of confidentiality survive the end of your employment or engagement.
You are responsible for having a lawful basis for the personal data you put into Conek about third parties, including, where relevant, the basis to record a call. See the Privacy Policy.
5. Intellectual property
Conek, its software, design, documentation and trade marks belong to A-SAFE and its licensors. A-SAFE® , Atlas®, eFlex™, FlexiShield™, ForkGuard™, iFlex®, Memaplex®, mFlex™, RackEye™, RackGuard™ and SenseSafe™ are trade marks of A-SAFE.
You are granted a limited, non-exclusive, non-transferable, revocable right to use Conek for A-SAFE’s business purposes for as long as your account is active. Nothing else is granted.
Third-party open-source components are licensed under their own terms, which prevail over these terms for those components.
6. Mobile apps
The mobile apps are distributed through the Apple App Store and Google Play. Your use of them is also subject to the terms of the store you obtained them from. Apple and Google are not parties to these terms, are not responsible for the apps or for support, and have no obligation to you in respect of them. Apple and its subsidiaries are third-party beneficiaries of these terms as they apply to the iOS app, and may enforce them.
The apps require an active internet connection and a valid Conek account. Some features depend on device permissions — camera, photo library, microphone, location, notifications — which you can grant or refuse in your device settings.
Where the app is installed on a company-managed device, A-SAFE’s device management policies also apply.
7. Availability and changes
We work to keep the service available, but we do not warrant uninterrupted or error-free operation. Planned maintenance and incidents are communicated in the product and through your A-SAFE contact.
We may change, add or remove features. Significant changes are announced through the Conek changelog and, for A-SAFE teams, the Super Users channel.
8. Disclaimers
To the maximum extent permitted by law, Conek is provided “as is” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. Outputs generated by AI features are suggestions and may be incomplete or wrong; they must be reviewed by a person before being relied on for a business decision, a quote or a price.
9. Liability
Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud. Subject to that, and to the extent permitted by law, A-SAFE is not liable to you for indirect or consequential loss arising from your use of the service.
10. Ending access
Access ends when your account is removed, which normally happens when your employment or engagement with A-SAFE ends, or when you close your own account — see Delete your account. On termination your right to use the service stops immediately; A-SAFE’s business records remain A-SAFE’s.
11. Changes to these terms
We update the date at the top of this page when these terms change. Continuing to use Conek after a change means you accept the updated terms.
12. Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, without prejudice to mandatory employee or consumer protections in your country of residence.
